Just because there is a picture of the figures does not necessarily mean that the figures that you are bidding on in the auction are not unused or unopened. I usually take and use one picture for more than one auction. The picture could be of his personal collection that he uses everyday just to show what the figures are, but that he is actually selling a set of unopened unused duplicate figures sitting on his desk.
It doesn't matter if the figures were opened or unopened as far as responsibility of merchandise on ebay. Hasbro is NOT responsible for anything other than an unopened BOX from a certified retail outlet. As a buyer on ebay you are responsible for what you purchase and what you receive. As a seller, I personally feel responsible and want my traders to get what they paid for and make amends if something is D.O.A., but that is my choice not any kind of legal responsibility. As many sellers state in their ad the buyer assumes most of the responsibility. There is risk, but there are also rewards.
Feedback and trust is all we really have to go on.
Also keep in mind that we are more than likely a relatively small community and most of the buyers and sellers of Attacktix on ebay have found their way here to this forum.
